Shop on Pickupp Terms Of Service

These Terms of Use (“Terms”) govern your use of the websites and mobile applications provided by HK PICK-UP Limited. (or referred to as “Shop on Pickupp”) (collectively the “Platforms”). Please read these Terms carefully. By accessing and using the Platforms, you agree that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced. Shop on Pickupp reserves the right to change or modify these Terms (including our policies which are incorporated into these Terms) at any time. You are strongly recommended to read these Terms regularly. You will be deemed to have agreed to the amended Terms by your continued use of the Platforms following the date on which the amended Terms are posted.

1. Orders

1. Shop on Pickupp will attempt delivery at the address you provide to us when you place your order. 2. Payment (a) Orders will be charged in Hong Kong dollars. (b) We use a third party payment service to process online transactions. (c) When you place an order, you agree and accept that your credit card information will be collected, processed, and kept by a payment service provider subject to its terms and conditions. (d) You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card transactions, and in no event shall any such losses in whole or in part be borne by us. (e) If you choose to save your credit card information for express checkout, you agree and accept that the information will be encrypted and stored by the third party payment service providers. (f) The company reserves the right to change the payment terms for any order without prior notice. 3. You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to): (a) Failed delivery due to unreachable recipient (with evidence of delivery attempt, i.e. delivery agent call log) (b) Failed delivery due to request to change item(s) and/or timeslot (recipient requests a different items/timeslot to original Purchase Order, and Pickupp/merchant is unable to fulfill). (c) Customer dissatisfaction with item(s) received (if item(s) were prepared correctly according to the information provided on the platform). (d) The delivery agent refuses to deliver the Item to you in accordance with age restricted products. 4. Shop on Pickupp may operate dynamic pricing some of the time, which means that prices of Items and delivery may change while you are browsing. 5. Adverse Weather Arrangement Delivery services shall delay when typhoon signal, a red or black rainstorm warning is hoisted; or such other weather conditions whereby delivery is considered unsafe. In this event, delivery will be automatically postponed to the merchant's next available day. You are obligated to contact our customer support if you would like to reschedule the delivery other than the next available day. 6. Age restricted products include (but are not limited to):, alcohol and adult toys can only be sold and delivered to persons aged 18 or over. By placing an order for an age restricted product, you confirm that you are at least 18 years old. Shop on Pickupp operates the Challenge 25 age verification policy whereby customers who look under aged 25 will be asked by the delivery agent to provide proof that they are aged 18 or over. The delivery agent may refuse to deliver any age restricted product to any person who does not look aged 25 unless they can provide valid photo ID proving that they are aged 18 or over. If delivery of any age restricted product is refused, you will still be charged for the relevant Item and for delivery. 7. If the performance by Pickupp of its obligations relating to the services it supplies on this site is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of the Government of the Hong Kong Special Administrative Region or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of Pickupp), Pickupp shall be excused from such performance to the extent of such prevention. 8. Shop on Pickupp reserves the right to cancel any Order and/or suspend, deactivate or terminate your Shop on Pickupp account in its sole discretion if it reasonably suspects or detects fraudulent behavior or activity associated with your account and/or with your Order.

2. Cancellation and Compensation

1. All confirmed purchases are final and no modifications, cancellations, or refunds are allowed. 2. All claims for compensation must be received by Pickupp within seven (7) days from the earlier of (1) the date of the receipt of the order, or (2) the original Purchase Order timeslot. The customer will also have to meet the following prerequisite conditions namely: (a) all valid supporting evidence to prove request for compensation/refund of the item(s); (b) all valid supporting documents to prove that the item(s) in problem is/are purchased from Shop on Pickupp; (c) immediately sending the photos/videos of the item(s) in problem to Pickupp as an evidential proof through email(s) or via our in-app customer support intercom.

3. Promo Code

1. Promo Codes offered in a particular country/region and currency cannot be used in a different country/region or currency. Promo Codes are usually offered subject to conditions, such as time limits, geographic limits, limits to particular categories of customer (e.g. new customers), or use only at a particular Partner Restaurant or for a particular menu item. If conditions apply they will be stated when we offer the Promo Codes. 2. Some Promo Codes are only available to new Shops customers ("New Customer Promo Code"). Shop on Pickupp reserves the right to refuse to apply and/or allow you to redeem a new customer Promo Code if you are registering a new account using credit card details or a delivery name and address already on our system. 3. Use of a Promo Code in payment or part-payment may also be subject to specific conditions applicable to that Promo Code only, such as a specific minimum order value or that the Promo Code may only be redeemed at a specific shop or on specific Items. If the order placed does not comply with the applicable conditions, the Credit may not be redeemed against that order. 4. Only one Promo Code can be redeemed per order. Promo Code cannot be redeemed in conjunction with any other Shop on Pickupp offer. 5. If you cancel an order made using a Promo code, the Promo Code credit will not be restored to the account and the Promo Code cannot be reused. If the Promo Code was a New Customer Promo Code, you will no longer be a new customer and will not be eligible for any subsequent new customer Promo Code.

4. E-Discount Vouchers

1. Shop on Pickupp is under no obligation to issue any E-Discount Vouchers until full payment for your Order has been received. 2. All E-Discount Vouchers will be sent to you by email. If there are any issues with your Order, you must notify Shop on Pickupp within 72 hours of delivery. 3. Shop on Pickupp is not responsible for E-Discount Vouchers sold or distributed by an unauthorised third party. 4. If an E-Discount Voucher is abused, or an E-Discount Voucher which we know or suspect was obtained fraudulently is redeemed and/or used to make purchases on our Service, Shop on Pickupp may: (a) suspend or close the affected Shop on Pickupp account ; and/or (b) cancel any E-Discount Vouchers
